1. Agreement to terms

By accessing the ThinCMS website ("Site") or purchasing a ThinCMS software license ("Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site or Software.

These Terms apply to all visitors, users, and license holders. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.

2. Software licenses

ThinCMS is available under several license tiers: Solo, Agency Freelancer, Agency Studio, and Agency Enterprise. Each tier grants specific usage rights as described on the Pricing page and the License Agreement.

Your license is effective upon purchase and continues for the duration specified in your license tier (annual or one-time, depending on the plan). Annual licenses require renewal to maintain access to updates and support.

3. Acceptable use

You may use ThinCMS for any lawful purpose consistent with these Terms. You agree not to:

— Redistribute, resell, or sublicense the ThinCMS source code
— Remove or alter any copyright, trademark, or proprietary notices
— Use the Software to operate a competing CMS product or service
— Attempt to reverse engineer any obfuscated or compiled portions of the Software
— Use the Site or Software in any way that violates applicable laws or regulations

4. Accounts and security

If you create an account on the ThinCMS website (for license management, support access, or community features), you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

5. Payments and refunds

All license fees are stated in US dollars and are charged at the time of purchase. Annual licenses renew automatically unless cancelled before the renewal date. We offer a 30-day refund policy — if ThinCMS doesn't meet your needs within 30 days of purchase, contact us for a full refund.

Prices may change with 30 days' notice. Price changes do not affect existing active license periods.

6. Intellectual property

ThinCMS, its logo, documentation, and all associated materials are the intellectual property of ThinCMS and its licensors. Your license grants you the right to use the Software as specified in your license tier — it does not transfer ownership of the Software or any intellectual property rights.

Content you create and manage using ThinCMS remains entirely yours. We claim no ownership or rights over your content, data, or media files.

7. Disclaimer of warranties

ThinCMS is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Software will be uninterrupted, error-free, or free of vulnerabilities.

8. Limitation of liability

To the maximum extent permitted by applicable law, ThinCMS and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from or related to these Terms or the Software shall not exceed the amount you paid for the Software in the twelve (12) months preceding the claim.

9. Termination

We may terminate or suspend your access to the Site or Software at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the Software ceases, though your self-hosted installation and data remain yours.

10. Changes to these terms

We may update these Terms from time to time. We will notify license holders of material changes via email at least 30 days before they take effect. Your continued use of the Site or Software after changes become effective constitutes acceptance of the revised Terms.
